The Jussie Smollett case just grew legs once again. Recently a special prosecutor was assigned to the case to look into Chicago’s top prosecutor Kim Foxx’ decision to drop all 16 charges against him at the last minute especially when the police department still maintains there’s plenty of evidence against him to prove him guilty. And the hell he put the city through allegedly faking a hate crime lead the former Mayor Rahm Emanuel to sue Smollett for $130,000 to cover the investigation. That was objected to by Smollett’s legal team who said they had no idea the city would go the extent they did and that it wasn’t their responsibility or problem.

Today, a judge gave the go ahead for the case the city has against Smollett to go ahead, denying his appeal. U.S. District Judge Virginia Kendall said “it isn’t unreasonable to think” that Chicago police would vigorously investigate his accusations given the voracity of the claims, his celebrity and the “volatile climate” of the times. This goes smack in the face to the 12 page motion Smollett’s attorneys filed saying investigations were
a “discretionary function” of police and that there was no proof of damages incurred.

“The filing of a police report, in and of itself, does not necessitate a sprawling investigation, nor does it, as a practical matter, usually result in an investigation as extensive as the one CPD chose to undertake in this case,” Smollett attorney William Quinlan wrote.

This ruling sets the case in the direction of a trial. This along with the special prosecutor further investigating this case means there’s still a chance Smollett can be charged with a crime. And Emmanuel’s parting motion in suing Smollett for the 1,900 of investigative hours used on him is just adding salt in the wound and clearly is the gift that keeps on giving long after he’s left office.
