Kim Kardashian is living proof that sex sells. Sources close to the Keeping Up with the Kardashian star are claiming she makes $1 million an Instagram post. To put this in perspective, a couple years ago, Nene Leakes was reported to make $1 million per season on the Real Housewives of Atlanta and Eva Marcille says she makes about $40,000 per Instagram post… an amount that even golddigger Marlo Hampton was shocked to hear, thinking that was a lot, so Kim’s doing pretty good. This was actually a correction to the $300,000 to $400,000 that Kim wrote in a lawsuit against a fashion brand using her image to sell their clothing without her permission.
The brand Kim is suing is Missguided USA, known for designing and making knock off clothes in a matter of hours based on the look of a celebrity. The problem is that they use the image of the celebrity whose style they’re knocking off and even tag them in the tweet. This isn’t that controversial of a process because that is exactly what Fashion Nova does… except they don’t post a picture of the celeb and tag them. That’s the illegal part. She also says she turns down social media gigs all the time because she doesn’t want to be associated with some of the brands approaching her. Since Missguided USA didn’t respond to her lawsuit, she’s now seeking a $5 million default judgment.
If she wins this case, it’ll be a teachable moment in copyright law that you can’t use the image of others without their permission and seek to profit off of them, especially when they’re not open licensed photos. They’re likely also liable to pay the photographers who used the images as well. All they had to do was sell their dresses without doing all of that. If they had license to use the photos of Kim and other celebs through the photo agencies, it might be another thing, but this? Nope. It’s totally inappropriate.
